IT IS ORDERED that the Bell County District Courts, the Bell County Courts at Law, and the Bell County Justice of the Peace Courts will provide essential functions and hearings only beginning tomorrow, March 17, 2020 and continuing through April 10, 2020. This Administrative Order includes the suspension of all jury trials through April 10, 2020. Examples of essential functions include criminal magistration proceedings, CPS removal hearings, temporary restraining orders/temporary injunctions, juvenile detention hearings and family violence protective orders. Attorneys are encouraged to use their best judgment in determining which hearings are emergency hearings and to work with each Court in making that determination. The listed cases will only be heard by special setting. If you have a need for one of these hearings, please contact the court and the need will be evaluated on a case by case basis, and a special date and time will be scheduled, If you currently have settings during this time period, they are cancelled effectively immediately and will need to be rescheduled on or after May 11, 2020. The court strongly suggests that all contested temporary and final family law matters attempt mediation before contacting the court for a setting. This court plan does not include CPS Court and Attorney General Court cases. The judges for those courts will implement their own court plans. Further, due to recommendations by the CDC and advisory opinions from the OCA, effective March 16, 2020, all attorneys and court staff traveling on domestic or international flights will be required to have a 14 day waiting period before participating in court matters. Essential hearings are criminal matters such as magistration, writs of habeas corpus, civil matters such as mental health commitments, juvenile detentions, emergency CPS removals, family violence protective orders, ex-parte temporary restraining orders, habeas corpus proceedings arising under the Texas Family Code and any other matter that may be deemed an essential matter by the Court. If there is a plea ready, an uncontested hearing, or if all parties agree on a ruling, please call the court to get a court date. Video conferencing is currently being evaluated for use in the courtrooms to conduct hearings by this method. Please do not come to the courthouse without calling the Court for any matter to be set in the County Courts at Law. Our courts remain open to answer questions, receive filings, process payments and perform other essential duties. Please note that this status could change at any time. We will accept filings for evictions and writs of possession, but be aware that scheduling and service of these filings will be delayed for 30-60 days. Anyone that has received a citation/ticket from March 13 forward will receive an additional 30 days to make an appearance in court. An "appearance" does not have to be in person. Closed until further noticeEpidemicAll four Justice Courts will be closed to the public. All phone calls will be answered during each court's normal business hours. All filings will continue to be accepted via mail or use of the drop box until normal court operations resume. -All scheduled court proceedings except for "essential court proceedings" will be reset. Each court will contact the litigants to notify them of the new reset date as soon as practicable for the court. Essential court proceedings are: • Writs of re-entry • Writs of retrieval • Writs of restoration • Magistration of defendants in custody and of fugitives of justice (in or out of custody) • Repair and Remedy Cases that materially affect the physical health or safety of a tenant • Inquest -No eviction settings (both residential and commercial) will be held UNTIL after May 8, 2020. No writs of possession will be issued by a Justice until May 13, 2020. -For traffic/Class C citations the appearance date will be extended and the court will notify defendants of a new rescheduled appearance date. This applies to cite-and-release charges and summonses for charges other than Class C misdemeanors as well. No warrants due to failing to appear for a traffic/Class C citation, cite-and-release charge, or a summons will be issued until further notice.Website

PandemicEffective 8:00am, March 20, 2020, all further court proceedings, including jury trials, bench trials, criminal dockets and ancillary matters, are hereby suspended until April 12, 2020, except for emergency orders pertaining to children, temporary restraining orders, temporary injunctions on a case-by-case basis, habeas corpus proceedings, CPS removals, and bond hearings, and other matters as determined by the Court. No writs of possession will be issued by the Justice Court for 60 days after the date of this order. For traffic/Class C citations with an appearance date prior to April 1, 2020, the appearance date may be extended on a case by case basis at the discretion of the Justice Court.
