Cancellation Policy
One of the ways we ensure the highest quality appearance counsel in the industry is by respecting the attorneys’ schedules and time commitments. When a hearing is posted and covered, the attorneys have reserved time in their schedule to appear for you and likely spent time preparing. So we have developed a cancellation policy and fee structure that tries to satisfy both parties knowing that last-minute issues do arise with these types of cases.
If the hearing is canceled within 24 business hours of the hearing time, the fee is 50% of the original price. If it is canceled the same day of the hearing, it remains at the full price. The best way to avoid the fee is to cancel the hearing before the 24 hours.
You may be aware that some of our competitors do not charge these fees. However, we feel that in the end, you will save more money with us and get better outcomes with this policy in place. We have tried it both ways. Attorneys will work for lower rates on average when they feel like their time is respected.
We do not generally make exceptions to the policy for the case being settled, defendants filing bankruptcy, court not being in session, and other interruptions. Weather is the only thing we regularly waive the fees for as we believe the attorney would not have been able to conduct regular business in that case anyway. Here is our weather, natural disaster, and pandemic policy. If you cancel a hearing because you've learned the court is closed due to weather, you should choose "Weather closure" for the reason for your cancellation.
Here is an explanation of our cancellation policy but for the full nitty-gritty, you should review our Terms of Use.
Still, we try to be fair and lenient. Here are the basic guidelines for canceled hearings:
Canceled anytime while not covered = No Fee
If it's covered by an attorney and cancelled outside of 24 hours before the hearing, there is no fee.
If it's covered by an attorney and canceled within 24 hours up to midnight of the hearing date, the fee is 50%.
If it's covered by an attorney and canceled after midnight of the hearing date, the full original fee is charged.
Please Note: Weekends do not count, so Friday cancellations for a Monday hearing are counted as within 24 hours (if the time of cancellation on Friday is after the time of the hearing on Monday - e.g. cancel at 11:00 am Friday for a hearing at 9:00 am Monday = half fee charged)
Bundles
When canceling a single hearing in a bundle, the guidelines above apply to that individual hearing. There also may be effects on the overall bundle price as well.
If the hearing now has a $0 fee, the hearing no longer counts towards the size of the bundle. As an example, if you had a 4 hearing bundle and you cancel one of them with no fee, it becomes a 3 hearing bundle. The 3 hearing bundle discount is less than the 4 hearing discount. So you can expect a rise in the price of your 3 hearings but the overall cost of your bundle is now less because you no longer have a 4th hearing. In the end, the pricing is all based on the final size of the bundle. There are no penalties for the time or order you do these operations, we only look at the final result.
If your canceled hearing has a fee associated with it, it continues to count as a hearing in the bundle size. So you will not see a change in the prices of the other hearings in the bundle in that case.
