Verification of Attorney non-Prohibited Practice Areas

As mentioned in the above pages, an Docketly staff member will verify the information provided by our network attorneys. One area that we, and our clients, are most concerned about are the various practices our network attorneys engage in during the course of their daily representation of clients. We make every effort to ensure that the following attorneys are not admitted in our network:

  • Those attorneys who practice debtor/collection defense;

  • Those attorneys who practice consumer/FDCPA law, or who represent plaintiffs in FDCPA actions;

  • Those attorneys who practice primarily in consumer bankruptcy; and

  • Those attorneys who practice primarily in subrogation defense.

We have strict rules that prohibit the approval of any network attorney who currently, or has in the past, represented any plaintiffs in an FDCPA action. However, given the nature of rural, solo or small firm, general practices, we do make an exception for those attorneys who represent, on occasion, debtors in bankruptcy.  Frankly, those attorneys are sometimes unavoidable to ensure that our clients' hearings are covered in a short amount of time, at a reasonable cost. Notwithstanding, any attorney applicant who actively markets and/or promotes the representation of debtors in consumer actions and/or bankruptcy, as the main area of practice, are prohibited from joining Docketly.
